I have done several evictions in over 18 years as a real estate investor and property manager. Also have negotiated succesfully with many tenants to avoid the evicition process. It is very important to get a non paying tenant out of the property immediately. Do not wait to evict as time is of the essence. The soonner you get the non paying tenant out the soonner you can rent the property to someone who will pay the rent on time.
The first thing I do is try to negotiate with the tenant. Usually the tenant will try to work something out with me even though they have refused to talk to the landlord. They see me as someone who is trying to help them. I explain to the tenants in a face to face meeting that it is in their best interest to move out of the property in order to avoid further action. I explain the eviction process to them and what will happen if they decide to stay in the property until the end. It is not a pretty sight to be evicted by the Sheriff. The eviction takes about three weeks in most cases so that the tenants do not have all the time in the world to stay rent free in the property. Once I did an eviction in less than 15 days.
Tenants have the mistaken notion that they can stay in the property for at least three or four months rent free. This is not the case anymore as the courts are siding more and more with the landlords. Most judges will not even hear the case if the tenants have not paid any money in the court registry. Another common mistake made by tenants is not paying the rent because the house is in foreclosure. Tenants have been evicted for non payment of rent even though the property is in pre-foreclosure and or short sale.
I prepare all the paperwork for the eviction for one small fee. The fee includes negotiating with the tenants so that an agreement can be reached and no eviction is necessary. Sometimes it is better to make a deal with the tenant so they can move out and the landlord takes possession of the property right away. In many cases no eviction is needed and the tenant agrees to move out. Eviction are done in Miami Dade, Broward and Palm Beach Counties.
Negotiating with the tenant is the key but at the same time the three day notice should be served. The tenant must be aware that he/she will be leaving the premises. Do not try to evict yourself if you do not know what you are doing as any mistake you make can be very costly and time consuming. The court will throw out the whole eviction if there are any mistakes in dates, money, omissions, wrong paperwork, etc. You do not get the court costs back and you must start the eviction process again from scratch.
