We completed an eviction in less than two weeks in Hialeah, Florida. The courts are now very aware of the non paying tenant’s effects on the foreclosure and overall real estate market. The system is now streamlined in order to get the tenants out quickly and efficiently. Starting the eviction process fast is more important than ever before. The Hialeah eviction lead was generated from my blog posts about my eviction services.

The owners contact me and I contacted the tenant and posted the three day notice on the same day. The tenant informed me that she was not going to move out and was not paying the rent. An “expert” had advised the tenant that an eviction would take from 3 to 4 months since she had one small child. I completed the eviction in two weeks. The tenant was very surprised at the speed of the eviction and decided to move out when the Sheriff posted the final eviction notice on the door. She moved out two days after the Sheriff posted the notice. The non paying tenant gave me the keys to the property, the keys to the mail box and the remote control for the gate.

The owners Luis and Karina are so happy with my services that the decided for me to handle the rental, tenant screening and other services for the unit. Luis said in an email that it was a job well done. I was able to find a tenant for the Hialeah unit very fast and we are now waiting for condo approval. The new tenant should be able to move in next week. Since the landlords have more rental residential and commercial properties I am working hard to handle all their property management needs.

Since I own rental income properties myself I understand the havoc that a non paying tenant causes on cash flow and the aggravation that it entails. I move quickly so that the tenant will be out fast and a paying tenant can move in right away. The bottom line is getting rent money again immediately. It is not fair that a tenant should be allowed to stay in the property indefinitely rent free. Starting the eviction process fast is essential since time is of the essence.

seedsOne of my tenants was growing marijuana in the back room in a house in NW Miami. In today’s economy is not unusual to find a grow house in Miami, Florida. There were over 20 buckets of seeds inside the house at an estimated value of $250,000 dollars. We went to collect the rent money on the first on the month but the tenant had already left the premises. The property manager and owner/landlord are responsible for the actions of the tenants.

The tenant would would for me outside with the rent money and so we would not go in the house. I asked Stan, the neighbor in the front and he assured me that all is normal in that house. This lasted for two months and on the third month the tenant is nowhere to be found. The door was wide open and we called the police immediately. The police went in and saw evidence of Marijuana grow house. They said the tenants were gone and probably will not be coming back. We have not seen the tenants again.

The two police men went to the entire neighborhood asking questions to see if someone had seen anything. No one saw anything and no one was aware that a grow house was right next door. The house had not oven range and no refrigerator. They plugged a big power plant generator to generate a huge amount of juice into the back bedroom. All windows were covered shut and two holes were made in the false ceiling.

There were 12 detective cars and two police cars. They went in the house and started taken finger prints and securing the area.  The detectives did not go in the house. They were waiting for a search warrant signed by the judge. They went to the judge’s house at night to get the warrant signed. I left the area at 11:00 at night and the detective stayed until 4:30 in the morning. The police confiscated everything, the lamps, generator, buckets, air conditioner, and seeds. The house was cleared and all evidence was taken. I was told the marijuana crop was already harvested and the tenants left leaving some unwanted equipment behind. The police estimated that they made $250,000 dollars.

The landlord is ultimately responsible for the tenant’s actions. You must go inside the premises at least twice a month to insure that everything is running smooth and there are no surprises. Now the property manager and owner have another thing to worry about. Not only do we have to collect rent, make repairs, maintain the property, etc. Now we must make sure that the tenant is not growing anything illegal inside the house. Miami real estate rental is a growing experience.

We started an eviction last week in the city of Lauderhill, Broward County, Florida. The owner lives in Jamaica and her son lives close to the property in Fort Lauderdale. They learned about my eviction services by reading my blog posts on the internet in Jamaica. The owners want me to handle all aspects of property management for the unit. Renting the unit, collecting the rent, handle repairs, evictions, etc. We agreed on terms and price and will begin to manage her property after the eviction takes place.

Both owners, mother and son, are very pleased with the way we conduct business in a very fast, efficient and professional manner. We have clients throughout the U.S. and Puerto Rico. We also have international clients located in Colombia, Venezuela, England, and now in Jamaica.

It is not unusual for me to secure the property management duties after I complete the eviction services. Sometimes I am able to get the tenant to resume paying rent plus late fees and therefore avoiding the eviction altogether. I negotiate with the tenant immediately so we can prevent the eviction process. Both parties win in this scenario.

In this particular eviction case the tenant refused to pay the rent and or leave the premises. The eviction was inevitable. We started the paperwork last week and already have filed for a default judgment since the tenant did not answer the court. We expect the tenant to leave the premises before the Sheriff comes out. It is the norm for the tenant to wait until the Sheriff serves the final eviction notice so they vacate the premises two or three days before.

As soon as we have possession of the property we will start doing the necessary repairs so we can rent the unit back out. The owner has not collected rent for two months and is in desperate need of money. The exchange rate is very high and the owner loses a lot of money in the currency exchange. She insists of a daily status report which I deliver to her email inbox. Julia is an outstanding lady and I am working very hard to get non paying tenant out right away and renting the unit immediately.

I am not happy with the new company that took over operations for The Miami Dade County Housing Authority Section 8 Program. The new company in Doral that took over is not doing a good job. I was informed that the new company would streamline the Section 8 voucher program and daily operations would run smoothly. Rent checks are late or not sent at all, initial inspections take more than a month, the staff is poorly trained and managers are inefficient and lack customer service skills. Miami Dade County must make changes soon or most landlords will refuse to rent to Section 8 tenants.

The following are my complaints in a three month period since the new company took over operations.

I did not receive the rental checks for August 2009. No explanation was given. I have been to the new Doral office numerous times to no avail. The people that answer the phones are not the same that are in the office. The wrong information is given over the phone. They said to go to the Doral office to get a replacement check. No checks are issued in that office and they mail the checks instead. No checks have been mailed as of today.

The rent increases for four properties for 2008 have not been processed. Section 8 is supposed to send the rental increase retroactive for the year 2008 but they only gave me an increase for 2009. When I ask about the rental increase I was told that Miami Dade was handling the increases for 2008 and the retro active increase would not be coming any time soon if at all.

The inspection department is very slow and not very experienced. It took one month for an inspection to be performed in a property in NW Miami. They said to the tenant that her paperwork was misplaced. Landlords would have to wait two months in order for the inspection and survey would be completed. I am still waiting for the initial inspection to be performed.

Management is inefficient and not trained properly. Not one manager or supervisor has returned any of my calls. Every time I asked for a supervisor I immediately go to a voice mail system in which you can’t even leave a message. The staff must be trained so they know what to do. Customer service representatives and receptionist personnel are not people friendly and lack basic communication skills.

Landlords now must schedule an appointment to see a customer representative. The appointment is usually within a two week period of the request. I had to wait two weeks in order to request a replacement check. There was a landlord in the Doral office that even called someone in Washington to complaint about the situation.

The Doral office is a zoo where hundreds of frustrated landlords and tenants alike must wait for hours to see a representative. Landlords and property managers should not have to ask for appointments that take two weeks. We must see a manager or customer service immediately. Rent payments and rent increases must be done right away. Initial inspections and surveys must be done fast so the tenant can move in and we can get paid.

It is a very frustrating and exasperating experience to deal with the new  Company. Actually, they changed the name so is not even Section 8 anymore. Miami Dade County should look at the way the new Section 8 Company is handling operations. Maybe privatizing Section 8 operations was not a good idea after all. Changes must be made fast so that landlords would continue to rent to Section 8 tenants.
